Arbitration & Mediation
What's the difference between mediation and arbitration? In a mediation process, a neutral, trained mediator works to help disputants come to a consensus on their own. In arbitration, a neutral, trained arbitrator serves as a judge who is responsible for resolving the dispute.
Commercial Law
Commercial law (or business law), which is also known by other names such as mercantile law or trade law depending on jurisdiction; is the body of law that applies to the rights, relations, and conduct of persons and organizations engaged in commercial and business activities. It is often considered to be a branch of civil law and deals with issues of both private law and public law.
Contracts
Contract law, the field of the law of obligations concerned with contracts, is based on the principle that agreements must be honoured. Like other areas of private law, contract law varies between jurisdictions.
Property Law
South African property law regulates the "rights of people in or over certain objects or things." It is concerned, in other words, with a person's ability to undertake certain actions with certain kinds of objects in accordance with South African law.
Litigation
What is litigation? Litigation means approaching a court of law to settle a dispute between two or more parties where a judicial officer (judge or magistrate) presides over the matter according to predefined procedures and issues a judgment after having considered the facts, evidence and arguments.
Divorce
In South African law, divorce means the legal termination of a marriage by means other than death of a spouse. South African courts encourage parties to reach settlements before the divorce reaches court, especially in cases of couples with minor children.
Labour Disputes
A dispute of right constitutes a legal claim to which a party to the employment relationship is entitled. This entitlement is constituted by virtue of the employment contract, a collective agreement, a statute or even common law.
Criminal Law
Criminal law is only one of the devices by which organized societies protect the security of individual interests and ensure the survival of the group. There are, in addition, the standards of conduct instilled by family, school, and religion; the rules of the office and factory; the regulations of civil life enforced by ordinary police powers; and the sanctions available through tort actions
Personal Injury Claims
A personal injury claim is a legal case you can open if you've been hurt in an accident and it was someone else's fault. It's the formal process of recovering compensation from the other party, who was responsible for your injury. This will usually come from their insurance company.
Ante Nuptal Contracts
An antenuptial marriage contract is a legal contract entered into by a couple before marriage that specifies things like the division of their finances and assets, especially in case the marriage ends, such as through divorce. The word antenuptial is an adjective that means before marriage.
Conveyancing
Conveyancing is the process of transferring property ownership from one person to another. It’s a distinct branch of law in South Africa, with its own rules and regulations that must be followed. Conveyancers are specially trained to deal with this process, which begins when a buyer’s conveyancer receives documentation related to the sale from their seller’s conveyancer.
Debt Collections
Debt collection is when an attorney, a person who is an agent of an attorney or a registered debt collector collects, on behalf of the credit provider, an outstanding amount plus lawful interest, admin costs and collection fees, which by law is capped to certain amounts.
Motor Vehicle accident Claims
It is essential that you pursue your claim as quickly as possible. If a claim is not submitted to the Road accident Fund or, in certain circumstances, court proceedings initiated within 2 or 3 years of your accident, your claim may prescribe. Then you will not be able to claim compensation at all.
Maintenance & Protection orders
A maintenance officer and an investigator will investigate your claim and look into your circumstances. The court will serve a summons (a letter instructing a person to come to court) on the respondent (the person against whom the claim is brought) to appear in court on a specific date to discuss the matter. A protection order aims at preventing the reoccurrence of domestic violence or sexual harassment by stating what conduct the alleged offender must refrain from doing. As long as he/she complies with the protection order, the complainant will be safe.
